Terms and Conditions
Our products are made from only the finest ingredients and with our imagination and attention to detail we strive to provide you with a gift that is special like no other. We at all times strive to comply with and exceed the requirements set out by all relevant legislation relating to the products and services we offer.
Our goods and services are offered subject to the following Terms and Conditions. These do not affect your statutory rights as a consumer under UK law.
1: PRODUCT
1.1 Products & Packaging
While we will at all times endeavour to provide you with the particular products and packaging ordered, where time deadlines or availability is constrained, we reserve the right to change or replace product and packaging without prior notice. Where these are replaced, such replacement will be with an equal or higher priced item. Where time allows, we will use our best endeavours to contact you in such a situation.
1.2 Nut Allergies & Special Diets
Unfortunately the majority of our products either contain nuts, or have been in the environment of nuts and, therefore, are not suitable for those with nut allergies. Similarly our products are not suitable for those on a dairy free or gluten free diet.
1.3 Gift Messages
We are pleased to supply gift cards with your purchases. Please note that if you choose a gift card as an option, Chocol8 reserve the right to refuse any message that we, in our absolute discretion, consider offensive, defamatory, abusive, obscene, racist or otherwise inappropriate.
1.4 Age Restrictions
Our products that contain alcohol are not suitable for those under 16 years of age. It is the responsibility of the person placing the order to ensure that any such products are not supplied to anyone under the age of 16. By placing an order for such products you explicitly warrant that you are over the age of 16 and assume full responsibility and liability for any harm caused as a result of your failure to comply with this term.
2: PRICES
2.1 Pricing
Prices of our gifts are as set out in our website and include VAT at the prevailing UK rate (17.5%). If you are eligible to claim back the sales tax, please contact us so that we may supply you with a VAT receipt.
2.2 Postage & Packaging
Postage is extra and we would refer you to our “Packaging” page for details and rates.
3: PAYMENT
3.1 Prices
All our prices are in GBP Pounds Sterling
3.2 Payment Methods
We accept payment by Visa, Mastercard, Maestro/Switch. All orders are positively credit card sanctioned prior to despatch so please ensure details provided are correct. Please note we cannot accept responsibility for orders not being despatched at the requested time as a result of incorrect or invalid payment details or where a card has been refused by the issuer. It is your responsibility to ensure that all the necessary card details have been provided and that sufficient funds are available to make the payment.

3.4 Disputed or Fraudulent Transactions
In the event of your disputing a transaction or your credit card being used fraudulently to make a purchase with Chocol8, you, as a consumer, are entitled to cancel the said payment(s). If, however, payment has already been made you are entitled, in accordance with the standing Consumer Protection Distance Selling Regulations (2000) to a re-credit, or to have all sums returned to you by the card issuer. Please contact your card issuer in such a situation.
4: CANCELLATIONS
4.1 Cancellation Pre-Dispatch
You may cancel your order at any time, up to 24 hours before your dispatch request date. In this event, please contact us on +44 (0)1202 766000.
4.2 Cancellation Post-Dispatch
In accordance with the Distance Selling Directive (2000) you may also return any unopened food item within 7 days of delivery. Should you wish to receive a refund, you must confirm in writing and return the complete packaged item(s) to:

Please Note: We would advise you that you are liable for postage charges for any returned items and we would suggest you ask for a “Proof of Postage”. We regret that we are unable to give refunds for items not received back. This does not affect your statutory rights.
5: RESALE
5.1 Resale Prohibited
Resale of any of our products or packaging is strictly forbidden. In placing an order with us you warrant that you will under no circumstances seek to sell or otherwise on-vend our products.
5.2 Your Liability
Where our products have been resold or an attempt been made to resell them in whatever format, we reserve the right to pursue you for any loss or damage caused to us including but not limited to trademark or copyright infringement, passing off and reputational damage.
6: LIMITATIONS & DISCLAIMER
6.1 Overseas Orders
We would like to make you aware that our delicate products are sensitive to heat and humidity changes and whilst we do ship to other countries, and our products are packed with great care and sensitivity to transport conditions, we cannot take responsibility for products that do not reach their destination in peak condition.
6.2 Broken Items
All our gifts are packed and dispatched with the utmost care and leave our hands in perfect condition, therefore, we are unable to take responsibility if any part of a gift is broken in transit by circumstances beyond our control.
7: PRIVACY & DATA PROTECTION
7.1 Privacy
At Chocol8 we are committed to protecting your privacy and accordingly assure you we will only use the information you provide lawfully and in accordance with the Data Protection Act 1998.
7.2 How we Process your Data
The information you provide allows us to process your order and to provide you with the best possible service we can and we will not contact you in the future unless you have given us your consent.
The type of information we will collect about you includes your name, your address (the recipients if different), postcode, phone number(s), email addresses. Chocol8 automatically receives and records information on our server logs from your browser, including your IP address, our cookie information (optional), and the page you request.
We will not sell or pass on to any third party the information you supply to us and will at all times operate within the terms of the Data Protection Act 1998.
